Terms of Service

Welcome to Sound Mind. These Terms of Service ("Terms") govern your access to and use of the Sound Mind mobile application (the "App") operated by Sound Mind from South Africa ("we", "us", or "our").
By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. The Service
Sound Mind is a faith-based mental wellness application that guides users through a 6-step neuroplasticity process rooted in scripture, alongside scripture-based audio meditations, declarations, and a gratitude journal.
We may modify, suspend, or discontinue any feature of the App at any time. Where reasonably possible, we will give advance notice of material changes.
2. Eligibility and Accounts
- You must be at least 13 years old to create an account.
- You must be at least 18 years old to purchase a subscription. Users aged 13–17 may use the App only with the consent and involvement of a parent or legal guardian.
- You are responsible for the accuracy of the information you provide and for keeping your password confidential.
- You are responsible for all activity that occurs under your account.
- You agree to notify us immediately at hello@soundmindapp.co if you suspect unauthorised access to your account.
3. Subscriptions, Free Trial, and Billing
3.1 Free trial
Sound Mind offers a 7-day free trial on both monthly and yearly subscription plans. You will not be charged during the trial period.
3.2 Auto-renewal
Unless you cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the price of the plan you selected. Subscriptions then automatically renew at the end of each billing period (monthly or yearly) at the then-current price until cancelled.
3.3 Payment
Payment is processed by Apple App Store (iOS) or Google Play Store (Android), not directly by us. The price displayed in the App is the price charged in your local currency by the respective store, inclusive of any applicable taxes.
3.4 Cancellation
You can cancel your subscription at any time:
- iOS — Settings → [Your Name] → Subscriptions → Sound Mind → Cancel Subscription
- Android — Google Play Store → Profile → Payments and Subscriptions → Subscriptions → Sound Mind → Cancel Subscription
Cancellation takes effect at the end of the current billing period. You will continue to have access to the App until that date. We do not offer prorated refunds for unused time within a billing period.
3.5 Refunds
Refunds are handled by Apple and Google according to their respective policies. We do not process refunds directly. To request a refund:
- iOS — reportaproblem.apple.com
- Android — support.google.com/googleplay
3.6 Price changes
We may change subscription prices from time to time. Any price increase will be communicated to you at least 30 days in advance and will only apply to billing periods starting after the notice period. You can cancel before the new price takes effect.
4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable law.
- Attempt to reverse-engineer, decompile, or extract the source code of the App.
- Use the App to harass, abuse, or harm any other person.
- Share your account credentials with anyone else, or use someone else's account without permission.
- Interfere with or disrupt the App's servers or networks, or attempt to circumvent any security measure.
- Upload or transmit malicious code, viruses, or any other harmful content.
- Use automated means (bots, scrapers) to access the App.
We may suspend or terminate your account if we reasonably believe you have violated these Terms.
5. Your Content
You retain ownership of the text you write into the App (thought entries, gratitude entries, custom declarations). By submitting content, you grant us a limited, non-exclusive, royalty-free licence to store, transmit, and process that content solely for the purpose of operating the App for you. We do not use your content for any other purpose. We do not use your content to train artificial intelligence or machine learning models.
6. Intellectual Property
6.1 Our content
The App, including its design, code, copy, audio narrations, declaration text, and original artwork, is owned by Sound Mind and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App except as expressly permitted by these Terms.
6.2 Scripture attribution
Scripture quotations marked NIV are taken from the Holy Bible, New International Version®, NIV®. Copyright © 1973, 1978, 1984, 2011 by Biblica, Inc.® Used by permission. All rights reserved worldwide.
6.3 Personal use licence
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download, install, and use the App for your personal, non-commercial use, in accordance with these Terms.
7. Important — Not Medical or Mental Health Advice
Sound Mind is not a medical device or a substitute for professional mental health care. The App offers reflective, faith-based wellness content. It does not diagnose, treat, cure, or prevent any mental health condition, disorder, or disease.
You should not rely on the App as a substitute for advice or treatment from a qualified medical, psychological, or psychiatric professional. If you are experiencing a mental health crisis or are at risk of harming yourself or others, seek professional help immediately.

Your use of the App is entirely at your own discretion and risk.
8. Disclaimers
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure from unauthorised access, or that any defects will be corrected.
To the maximum extent permitted by law, we disclaim all liability for any reliance you place on content within the App.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Sound Mind, its operator, or any sub-processor be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or any other intangible loss, arising out of or in connection with your use of (or inability to use) the App.
Our total aggregate liability to you for any claim arising from or relating to the App or these Terms shall not exceed the greater of (a) the amount you have paid to us through Apple or Google for the App in the 12 months preceding the claim, or (b) ZAR 500.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under South African law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
10. Indemnity
You agree to indemnify and hold harmless Sound Mind, its operator, and its sub-processors from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the App, or your violation of any law or third-party right.
11. Termination
You may stop using the App and delete your account at any time via Profile → Data & Privacy → Delete All Data in the App.
We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law. Provisions of these Terms that by their nature should survive termination (including Sections 5, 6, 8, 9, 10, and 12) shall survive.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of South Africa, without regard to its conflict of laws rules.
Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved within 30 days, it shall be referred to mediation, and if mediation fails, to the exclusive jurisdiction of the courts of South Africa.
This Section does not deprive you of any mandatory consumer protection rights you may have under the law of your country of residence.
13. Changes to These Terms
We may update these Terms from time to time. If we make a material change, we will notify you through the App or by email at least 14 days before the change takes effect. Your continued use of the App after the change takes effect constitutes acceptance of the updated Terms.
